MILWAUKEE -- Fresh off of his federal conviction of extortion and bribery, former Milwaukee Alderman Michael McGee Jr. lost his battle to have his state bribery and battery case thrown out.Thursday was the third time McGee's attorneys fought to have his state case dismissed. In May, they had a small victory when the judge delayed the trial because conversations obtained from a body-wired informant were not translated from Arabic to English.
In court on Thursday, the defense argued that the state had still not complied with the court's order to translate the transcriptions."At every instance when the state has an opportunity to comply with the court's request, they sidestep. They scurry," attorney Larry Jarrett said. But prosecutors fought back, accusing the defense of stonewalling."They have -- the defense that is -- a history of bringing things up for the first time when they walk in," Assistant District Attorney Bruce Landgraf said. "I don't know what to say other than they've gotten 59 pages of transcription, and I'm looking at it, and it's like 8-point type." After much legal wrangling from the defense and prosecution, the judge made his ruling.McGee will go to trial Dec. 8.Once hearing the judge's decision, McGee's attorney remained emphatic about not cutting a deal with the state."Why should he take a plea deal?" Jarrett asked. "Mr. McGee believes that he's innocent. We believe that he's innocent, and we will go to trial."
