Court Upholds Conviction Of Elkhorn Man Who Killed Parents

A state appeals court has upheld an Elkhorn man's conviction in his parents' deaths.

Prosecutors said Craig A. Swope killed his mother and stepfather in January 2004, stole their money and left their bodies to rot in their house.

A jury convicted him of two counts of homicide in September 2006.

Swope argued on appeal an FBI agent wasn't qualified to testify about how Duane and Carolee Recob may have died and improperly relayed other experts' opinions to jurors.

The 2nd District Court of Appeals disagreed. It ruled the agent's experience and education qualified him to testify and experts can testify about their opinions even if those opinions are based on another's work.

Swope was also convicted of forging 19 of his parents' checks and a power of attorney document involving them.

Swope's attorney, Dianne M. Erickson, declined to comment.
